THE JURY VERDICT

After a 5-day jury trial in Howard County, Adam M. Spence and Garrett E. Brierley, of SPENCE | BRIERLEY, obtained a $150,000.00 jury verdict against a large regional Landlord on behalf of their Tenant client. 

DETAIL OF THE DAMAGES AWARDED, INCLUDING PUNITIVE DAMAGES

The Tenant’s claims included breach of contract, negligence, constructive eviction, and retaliatory action, related to the Landlord’s conduct and repeated failure to remedy mold contamination reported in May 2018, which led to the Tenant vacating the premises over an 11 month period. During the displacement, the Tenant incurred significant out of pocket expenses and was ultimately awarded compensatory damages of $25,000. The remaining portion of the verdict included an award for emotional distress and punitive damages, and the ability of Tenant to petition the Court for attorney’s fees.  No medical damages were sought in this case.

OTHER MONEY RECOVERED FOR TENANT PRIOR TO TRIAL

Months prior to the trial, Landlord also “ultimately” agreed to conduct and pay for the professional remediation of the Premises as well as the contents therein which could be professionally cleaned.  All, but ½ month of rent, was also abated during the 11 months displacement period.
